McClintock Distilling Releases Black is Beautiful Spirit for Juneteenth

McClintock Distilling, Frederick, Md., released the second edition of the Black is Beautiful Spirit on June 19th at the distillery and through Black Owned and managed restaurants in Maryland and DC.

This spirit is part of the international Black is Beautiful initiative from Weathered Souls Brewery in San Antonio. The spirit was a collaborative effort using the Weathered Souls recipe, brewed by Idiom Brewing and distilled, barrel aged and infused with Dark Chocolate Cacao nibs at McClintock Distilling. One hundred percent of the sales of this product is donated to the Maryland ACLU from McClintock Distilling and partner distributor, Bacchus.

Heaven Hill Distillery Releases Five Brothers Small Batch Bourbon

A small batch blending of five ages of Bourbon, Five Brothers Bourbon pays homage to the courage, dedication and solidarity of the five Shapira brothers who started the distillery in 1935.

Five Brothers Bourbon is comprised of Heaven Hill’s traditional Bourbon mashbill aged from five- to nine-years-old to represent each founding brother. Bottled at 90 proof to reflect the initial proofs of Heaven Hill releases in the early stages of the distillery, the new small batch is a callback to the beginnings of Heaven Hill’s award-winning portfolio.

“In 1935, my father and his four brothers invested in a speculative venture that today is the largest family-owned and operated distillery in America, Heaven Hill Distillery,” said Max L. Shapira, Heaven Hill President. “With patience and perseverance, they built the foundation for the nationally acclaimed American Whiskey portfolio we enjoy today and a legacy built on consistent quality and innovation.”

The most striking detail of the premium bottle is the face label feature of a black and white photo of the five Shapira Brothers when they were in their 20’s and early 30’s: David, Ed, Gary, George, and Mose. The packaging also showcases complimentary nods to the 1930’s with vintage paper face and back labels, an Americana color scheme, and a classic navy and gold tax strip to seal the cork. Five Brothers Bourbon is available in 750ml for $59.99 at the Heaven Hill Bourbon Experience and select Kentucky retailers.

On-Premise Velocity 78% Higher Than Year Ago, But Lower Than in 2019

CGA’s latest sales data reveals On-Premise velocity in outlets currently trading is +78% higher than the same time last year in the week to June 12. The comparable week last year (to June 13 2020), while in recovery compared to the height of restrictions, was still lower than the same week in 2019.

Average outlet dollar sales (velocity) trends are slightly positive (+2%) in the latest week (June 12 vs June 5) across the average U.S. outlet.

All key states experienced a boost on Memorial Day (May 31), with resulting negative trends vs the previous week on the Monday after (June 7), CGA said. Positive trends on the Tuesday and Wednesday of the latest week are likely to be due in part to poor performance on those days in the previous week, as many people will have gone out on Memorial Day rather than the following days.

Trends in Florida continue to fluctuate.  Compared to the same week a year earlier, sales are up 36%.  But compared to the prior week, were down 3%,largely driven by trends in Orlando (-16%) and Miami (-5%). Tampa (+0%) and the rest of the state (-1%) are either flat or negative.

In Illinois, sales compared to the like year-earlier week were up 130%, and were up 6% compared to the previous 2021 week.   But compared to the week ended June 15, sales velocity is down 14%.

California entered its third consecutive week of week-over-week growth,with all cities experiencing positive trends in the latest week, with Los Angeles up +5%, San Diego up 6% and San Francisco up 5%, driving growth for the state as a whole.  On a year-over-year basis, velocity is up 203% compared to the same week a year earlier, and 3% higher that the like week in 2021.

Strong performance in Houston (+10%) and growth in Dallas (+2%) result in positive weekly trends for Texas (+2%) after three weeks of decline, despite Austin (-2%) experiencing negative trends in the latest week.  Sales velocity is now +39% vs June 15, 2019 and up 57% year-over-year, CGA said.

NJ Senate Panel Backs Equalizing Tax for Spirits- and Malt-Based RTDs

It doesn’t seem fair.  Spirits-based ready-to-drink products are taxed in New Jersey at a rate 46 times that of malt-based RTDs.  Yesterday (6/17), the New Jersey Senate Budget & Appropriatons Committee overwhelmingly passed SB 3452, legislation to equalize the tax rate for spirits-based and malt-/beer-based ready-to-drink (RTD) products with similar alcohol by volume (ABV) up to 9.9% ABV.

Jay Hibbard, senior vp-state government relations at the Distilled Spirits Council of the U.S., and John Granata, co-founder of Jersey Spirits Distilling Co. and president of the New Jersey Craft Distillers Guild, submitted testimony in favor of the bill.

Hibbard’s testimony highlights an economic analysis conducted by DISCUS which indicates the New Jersey Treasury would realize more than $34 million in new tax revenue from the RTD category within three years based on the new excise tax rate and New Jersey’s current sales tax rate.

“New Jersey is one of many states working to ensure RTD products are being taxed fairly to support consumers and small businesses in their marketplace,” Hibbard said“To do so, these states are taking a closer look at the issues that prevent consumers from having equal access to spirits-based RTD products. New Jersey is also not the only state in which the beer industry has decried this type of consumer-friendly legislation and leveled myth-based criticisms at the spirits industry. There is no scientific, public safety or public policy basis to treat distilled spirits products differently than beer and wine – especially when the products, such as RTDs, have the exact same alcohol by volume.”

It also notes equalizing the tax would increase jobs in New Jersey’s spirits industry, which supports more than 55,000 New Jersey jobs and $1.5 billion in wages.

Granata’s testimony highlighted the negative impacts his business faces by having his products taxed nearly 46 times that of his beer counterparts in the state.

“Allowing distillers to have parity in this space would enable growth and expansion and would create more tax dollars through equipment investments, the purchase of raw materials and the hiring of new employees,” said Granata. “The canned RTD market is pretty new, and we should all have the opportunity to produce like products at like tax rates, and customers deserve to make choices of their own. We urge you to look at the facts rather than the rhetoric and allow us to compete on an even playing field with all our alcohol industry members. We want parity, not protectionism. Customers deserve to make choices of their own.”
